The terms under which Growthify Ltd provides the Kolekt service. Plain English where possible; legalese where required.

Working draft
Kolekt is in private beta. This document is a working draft and will be reviewed by Growthify Ltd's legal counsel before any customer data is collected. Operators considering Kolekt for regulated workloads should request the executed version when it issues.
Who these terms are between
These terms are between Growthify Ltd ("Growthify", "we", "us") and the business or individual that signs up for a Kolekt account ("you", "operator"). Growthify is registered in England & Wales.
What Kolekt is
Kolekt is an AI receptionist service. We answer your inbound phone line on your behalf, capture lead and booking information, and deliver it to you via the dashboard, email, and SMS. The service is provided "as a service" — operators do not host or self-manage components of Kolekt.
Account responsibilities
You are responsible for: keeping your account credentials secure; configuring your knowledge base, hours, and routing accurately; ensuring your end-callers' interactions with Kolekt comply with applicable law in your operating jurisdiction; and paying the subscription fees due under your selected plan.
What we are responsible for
We are responsible for: operating the Kolekt service per the published service description; safeguarding the personal information processed on your behalf per the Privacy Policy and DPA; providing reasonable uptime and incident response.
Pricing and billing
Pricing is per the plan you select. Setup fees are one-off and due on activation. Subscription fees recur monthly. Specific fee schedules and overage handling will be set out in the executed version of these terms and the Order Form for your account.
Term and termination
The agreement runs month-to-month unless an Order Form sets a longer term. You may cancel at any time effective at the end of the current billing month. We may terminate for material breach (including non-payment) on notice and a reasonable cure period.
Limitation of liability
To the maximum extent permitted by applicable law, Growthify's aggregate liability under or in connection with the agreement is limited to the fees paid by the operator to Growthify in the twelve months preceding the claim. This limit does not apply to obligations that cannot be limited under applicable law.
Governing law
These terms are governed by the laws of England & Wales. Disputes are subject to the exclusive jurisdiction of the English courts, except where Canadian consumer or privacy law confers a right that cannot be waived.
Changes to these terms
We will notify operators of material changes by email at least thirty days before they take effect. Continued use of the service after the effective date constitutes acceptance.
